Fort Wayne construction company Brooks Construction is refusing to repay more than $5 million to the Indiana Department of Transportation (INDOT) over issues of asphalt roads cracking only three years after they were paved.
Indiana Investigating $71M Crumbling Asphalt Issue
Brooks Construction claims the agency tested its mixture 72 times during construction.
INDOT sent a letter to Brooks Construction in September demanding a complete redo of the roadwork and $5.1 million reimbursement.
Brooks Construction claims the cracks stem from "technically flawed post-completion forensic testing" which INDOT performed in 2014 and 2015.
